Mission to Croatia on the execution of ECHR judgments concerning the protected tenancy scheme and treatment of asylum seekers at borders  

On 4 and 5 October, the Execution Department carried out a mission to Croatia on the implementation of the ECHR judgments concerning violations of property rights due to statutory limitations on the landlords’ use of flats subject to protected leases (Statileo group). Consultations were held with the representatives of the Minister of Spatial planning, Construction and State Assets and the Constitutional Court to discuss legislative measures required to abolish the protected tenancy scheme. The authorities informed that a new draft law is under preparation in order to fully execute the ECHR judgments.

The Department also met with the Minister of the Interior and State Attorney General to discuss measures required for the implementation of the ECHR judgment in M.H. and Others concerning, notably, an ineffective investigation into a migrant child’s death at the borders, conditions of asylum seekers’ detention and collective expulsions. In this context, the delegation had also exchanges with the Office of the Ombudswoman and the Ombudswoman for Children, the new mechanism monitoring police action in the area of illegal migration, as well as civil society organisations. The authorities showed a clear determination to adopt individual and general measures for the execution of the ECHR judgment which include reopening of the criminal investigation into the migrant child’s death, review of asylum law, and training and awareness raising activities targeting, notably, the police in order to prevent similar violations of the Convention.

Lastly, meetings were also held with the President of the Supreme Court to discuss issues concerning the reopening of proceedings pending at national level after the delivery of ECHR judgments, as well as with the Expert Council for the Execution of ECHR judgments, an inter-institutional body whose work facilitates the efficient execution of ECHR judgments.
