Romania: Bilateral exchanges on the implementation of domestic court decisions

On 19 June, the Department for the Execution of Judgments had an online meeting with the relevant national authorities on the progress made and the way to move forward to guarantee the prompt and voluntary implementation of domestic court decisions by public debtors. This issue is supervised by the Committee of Ministers in the framework of the group of cases Săcăleanu v. Romania.

Representatives of the Prime Minister’s Chancellery, the Government General Secretariat, and of the Ministries of Interior, Finance, Justice and of Development, Public Works and Administration as well as the Government Agent and Co-Agent of Romania before the European Court participated in the meeting.

The exchanges focused on the progress made in making fully operational the mechanism of prevention and control established under the Government General Secretariat to oversee the implementation of domestic court decisions by public debtors, recently broadened to cover also situations where debtors are parts of local administration; relevant good practices developed at national level which could be adapted and generalised; and areas where the authorities should consider further measures, legislative or other, in order to address fully and lastingly the issues raised in the relevant judgments of the Court.

The judgments where the European Court found issues because of the non-implementation of pecuniary awards against State-controlled companies, which were in bankruptcy or had been liquidated, were also discussed with a focus on the concrete elements that led the Court to hold the State directly responsible for those debts.

The Romanian authorities are expected to inform the Committee of the recent developments and the next steps in the execution process.
