On 28 July, the Department for the Execution of Judgments of the European Court of Human Rights participated virtually in the International Conference “The Constitution of Ukraine and European Values: Challenges of the European Integration Process”, which took place in Kyiv. The conference was organised by the Constitutional Court of Ukraine, the National Academy of Legal Sciences of Ukraine and with the support of the Council of Europe Office in Ukraine. The judges of the Constitutional Court, the President of the Supreme Court, the judge of the European Court of Human Rights in respect of Ukraine, as well as the Chair of Parliament, representatives of the academia and international partners participated in the conference.
The participants discussed recent developments in constitutional doctrine and jurisprudence as well as protection of human rights during martial law. In particular, participants referred to the Constitutional Court’s recent decisions leading to legislative reforms in Ukraine. These decisions played a crucial role for the implementation of the Petukhov (No.2) group of cases concerning the problem of irreducibility of life sentences, and the Oleksandr Volkov group of cases related to the independence and impartiality of the judiciary. Moreover, several pending constitutional cases are likely to be decisive for the implementation of the Zelenchuk and Tsytsyura group concerning the long-lasting moratorium on the alienation of agricultural land, as well as the Zhovner / Yuriy Ivanov / Burmych and Others group which concerns the major structural problem of non-enforcement or delayed enforcement of domestic judicial decisions.
