6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui d’ovocyte ? Non c. d’embryon ? Le don d’embryon en tant que tel n’est pas réglementé par la loi. La loi relative à la protection de l’embryon prévoit toutefois qu’un ovocyte ne peut être fécondé artificiellement à des fins autres qu’une grossesse chez la femme qui a fourni l’ovocyte (article 1, paragraphe 1, n°2 de la Loi sur la protection de l’embryon) ; il est de plus interdit de prélever un embryon sur une femme avant la fin de la nidation pour le transférer à une autre femme (article 1, paragraphe 1, n° 6 de la Loi sur la protection de l’embryon). Enfin, la Loi contient des dispositions visant à empêcher la création d’embryons surnuméraires au cours d’une fécondation artificielle (notamment l’interdiction de procéder à la fécondation artificielle d’un plus grand nombre d’ovocytes qu’il n’est permis d’en transférer chez une femme au cours d’un cycle – article 1, paragraphe 1, n° 5 de la Loi sur la protection de l’embryon). Par conséquent, l’autorisation d’un don d’embryon est seulement envisageable dans le cas exceptionnel où un embryon créé artificiellement ne peut plus, contre toute attente, être transféré chez la femme qui avait fourni l’ovocyte.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui / d’ovocyte ? /d’embryon ?
Les gamètes ne peuvent être utilisés en vue d’une procréation médicalement assistée qu’après une évaluation médicale complète, s’il y a une indication médicale et si la santé du receveur et celle de l’enfant sont garanties (article 6, paragraphe 1, de la réglementation relative aux tissus et aux cellules de la Loi sur la transplantation) En outre, l’utilisation de spermatozoïdes en vue d’une fécondation hétérologue dans le cadre de la procréation médicalement assistée passe nécessairement par une évaluation médicale du donneur de sperme, pour s’assurer qu’il satisfait aux critères relatifs à l’âge, à l’état de santé et aux antécédents médicaux et que l’utilisation de son sperme ne mettra pas en danger la santé d’autrui. Les renseignements nécessaires concernant le donneur doivent être recueillis au moyen d’un questionnaire, puis d’un entretien individuel entre le donneur et le médecin.
La prise en charge financière par la caisse d’assurance maladie est subordonnée à une limite d’âge (voir la réponse à la question 4).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Dans le cadre d'un engagement volontaire, les médecins, les banques de sperme et les laboratoires ont limité à 15 le nombre d'enfants issus d'un don de sperme (Richtlinien des Arbeitskreises für Donogene Insemination zur Qualitätssicherung der Behandlung mit Spendersamen in Deutschland).
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Le droit allemand comprend les dispositions suivantes régissant la relation juridique entre l'enfant et le conjoint du parent légal :
- Le conjoint/partenaire enregistré d'un parent qui a la garde exclusive de l'enfant (autorité décisionnelle) a le droit de s'exprimer sur les questions de la vie quotidienne (ce qu'on appelle la "petite garde" - article 1687b(1) du code civil, article 9(1) de la loi sur le partenariat de vie enregistré). En cas de danger imminent, le conjoint/partenaire enregistré a également le droit d'accomplir tous les actes nécessaires au bien-être de l'enfant (article 1687b(2) du code civil, article 9(2) de la loi sur le partenariat de vie enregistré).
- Droit de contact avec l'enfant, si une "relation sociale de type familial" s'est développée entre le conjoint du parent et l'enfant (article 1685, paragraphe 2, du code civil),
- Si l'enfant a vécu dans un ménage avec l'un des parents qui décède ou n'est plus en mesure d'exercer l'autorité parentale ou dont l'autorité parentale a été suspendue, le tribunal peut rejeter la demande de l'autre parent de lui confier l'enfant et ordonner que l'enfant reste avec le conjoint/partenaire enregistré du premier parent (d'office ou à la demande de ce conjoint), à condition que l'enfant ait vécu dans ce ménage pendant une période plus longue (article 1682, phrase 2, du code civil). Des règles similaires s'appliquent pour le séjour avec le partenaire d'un parent décédé ou d'un parent qui ne peut pas exercer son autorité parentale.
Conformément à l'article 1741, paragraphe 2, phrase 4, du code civil et à l'article 9, paragraphe 7, phrase 1, de la loi sur le partenariat enregistré, un conjoint/partenaire enregistré a le droit d'adopter l'enfant biologique de son conjoint/partenaire enregistré. Conformément à l'article 1742 du code civil/à l'article 9(7), phrase 2, de la loi sur le partenariat enregistré, un conjoint/partenaire enregistré peut également adopter l'enfant adopté par son conjoint/partenaire enregistré. Il n'y a plus de distinction entre les couples mariés hétérosexuels et homosexuels, les partenaires enregistrés ou les couples stables mariés et non mariés lorsqu'ils souhaitent adopter l'enfant de leur partenaire (article 1766a du code civil). En outre, les couples mariés, quel que soit le sexe des conjoints, peuvent adopter tout autre enfant en tant que parents communs, alors que les couples non mariés et les partenaires enregistrés n'ont pas cette possibilité de devenir simultanément parents communs de l'enfant. Ils doivent adopter l'enfant successivement.
