Ukraine: International conference on Administrative Justice

On 4-5 July, the Department for the Execution of Judgments of the European Court of Human Rights participated virtually in the VIIth International Scientific and Practical Conference “Administrative Justice in Ukraine: Issues of Theory and Practice” dedicated to judicial protection of political and civil rights and freedoms in pre-war, war and post-war periods. The conference organised by the Supreme Court was attended by representatives of the Government, the Parliament of Ukraine, academia, civil society as well as international partners.

The discussion focused on the balance between private and public interests and the influence of administrative case-law on the development of the state’s social policy. The participants exchanged their views on challenges in developing social policies by the state, adjudicating disputes concerning social benefits as well as enforcing domestic court decisions granting social benefits. In this respect special attention was paid to the Zhovner / Yuriy Ivanov / Burmych and Others group of cases concerning the major structural problem of non-enforcement or delayed enforcement of domestic judicial decisions and thus major rule of law and access to justice problems.

The participants underlined the State’s wide margin of appreciation in balancing the rights in relation to economic policies, especially in times of war, and highlighted the need to avoid creating new social obligations without the provision of adequate public funding.
