Organised by the Council of Europe Department for the Execution of Judgments of the European Court of Human Rights in the framework of the project “Removing the obstacles to the non-enforcement of domestic court judgments / Ensuring an effective implementation of domestic court judgments”, which is funded by the Human Rights Trust Fund.
Description: In recent years, the non-execution or delayed execution of judgments has become one of the most important problems of the judicial systems in Europe. This has been revealed by numerous judgments of the European Court of Human Rights and is still generating numerous applications in Strasbourg.
This situation has already given rise to pilot judgments of the European Court of Human Rights in which a particular emphasis was placed on the respondent states’ obligation to introduce a domestic remedy or a combination of such remedies within a specific deadline.
The round table “Effective remedies against non-execution or delayed execution of domestic court decisions” aims at sharing member-states’ experience in addressing specific issues related to domestic remedies in case of non-execution or delayed execution of domestic court decisions, in particular when facing important structural problems.
Participants will also discuss the experience of member states in response to the pilot judgments of the Court and their impact. The discussions will be based on a comparative analysis of the reforms adopted or underway in some countries. This analysis is reflected notably in the Committee of Ministers’ resolutions and memoranda issued in the context of its supervision of the execution of the Court's judgments, as well as other relevant Committee of Ministers’ Recommendations.
The round table will bring together high-level representatives from Albania, Azerbaijdan, Bosnia and Herzegovina, Croatia, Greece, Moldova, Poland, Romania, the Russian Federation, Serbia and Ukraine.
