The “Casebook on European Fair Trial Standards in Administrative Justice” issued by the Council of Europe in co-operation with the Folke Bernadotte Academy is the first of its kind, providing a systematic and accessible overview of what administrative justice means for Council of Europe member states. The case law of the European Court of Human Rights on the right to a fair trial is described and analysed in relation to administrative proceedings.
The Casebook has been translated to Turkish within the scope of the joint EU – Council of Europe Project Increasing the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State and published in March 2021. The casebook is intended to raise awareness of the Turkish administrative justice community, to support the reform efforts and the implementation of the international standards and principles of administrative justice system in Turkey.
The Casebook will help practitioners in the field of administrative justice to ensure the observance of the fair trial standards and their principles applicable under Article 6, paragraph 1, of the European Convention on Human Rights and, by doing so, to further strengthen the rule of law and the accountability and transparency of public administration and administrative justice.
This publication is intended to be shared with members of the Turkish Administrative Judiciary and will also be used as a training resource under the Project.
The Joint Project on “Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State” is implemented by the Council of Europe, and co-funded by the European Union, the Republic of Turkey and the Council of Europe.
