Civil society organisations strengthen their capacities on individual application in immigration detention cases

Civil society organisations (CSOs) working in human rights and migration have enhanced their ability to advocate for the rights of persons in immigration detention following a two-day training on "Individual Application in the Context of Immigration Detention" held in Ankara. The training brought together 23 legal professionals from the Association for Social Development and Aid Mobilization (ASAM) and various CSOs working in human rights and migration in Türkiye.

Throughout the two-day session, participants gained valuable insights into key legal principles related to individual applications in immigration detention cases. Key topics included the application process to the Turkish Constitutional Court, conditions of immigration detention, the prohibition of ill-treatment, the right to liberty under Article 5 of the European Convention on Human Rights, and alternative measures to detention.

Interactive sessions and case studies provided participants with practical skills, such as exhausting legal remedies, challenging detention decisions, and filing individual applications effectively. By applying these techniques to real-world scenarios, participants strengthened their ability to navigate complex case law and advocate for enhanced human rights protection through individual applications before the Turkish Constitutional Court.

The training was organised under the European Union and the Council of Europe joint action “Strengthening the human rights protection in the context of migration in Türkiye”  which is part of the joint European Union and Council of Europe Programme “Horizontal Facility for the Western Balkans and Türkiye”, in co-operation with the joint action Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights co-funded by the European Union and the Council of Europe and implemented by the Council of Europe.
