A comprehensive study on national practices and case law on alternatives to immigration detention in four countries has been completed, translated, and published with the expert support of the European Union’s and Council of Europe’s Joint Action “Strengthening Human Rights Protection of Migrants and Victims of Human Trafficking in Turkey”.
The study provides a comprehensive overview of the existing alternative measures in Austria, the Netherlands, the United Kingdom, and Canada, as well as information about their practical implementation, criteria for their use, human rights considerations, and relevant decisions from the national courts.
The study was conducted with the view to providing guidance to Turkish authorities in developing the secondary legislation on alternatives to immigration detention following the amendments to the 2013 Law on Foreigners and International Protection (LFIP) in December 2019, which introduced a range of alternatives to immigration detention in Türkiye.
In light of its comprehensive approach, the study also constitutes a useful source of information on alternatives to immigration detention for all actors working in the field of asylum and migration in various national contexts.
