STUDY VISIT TO GERMANY ON ADMINISTRATIVE JUDICIARY

A second study visit by a Turkish delegation took place on 29 May – 3 June 2022 to Munich and Leipzig in Germany within the scope of the EU-CoE Joint Project on “Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State”. The visit aimed to provide participants with an insight into the current administrative justice system in Germany.

The Turkish delegation consisted of the Deputy Minister of Justice, some members of the Council of State, a member of the Council of Judges and Prosecutors, the Chief Inspector of the Board of Inspectorate of the Council of Judges and Prosecutors, a Director General and judges from the Ministry of Justice, the President of the Bursa Regional Administrative Court and the President of Istanbul 15th Tax Court.

The visiting delegation had the opportunity to learn about the German administrative justice system, including the issues concerning the specialisation of the courts and various pilot practices on alternative dispute resolution. During the visits to the High Administrative Court of Bavaria, where the delegation observed a court hearing, Munich First Instance Administrative Court, the Ministry of Interior, the Federal Administrative Court of the Republic of Germany based in Leipzig, and the Federal Association for Administrative Judges knowledge and experience on the current state of the administrative justice institutions, administrative justice procedure under the law and practice, measures for execution of judgments, appeal process, orality in administrative litigation and the challenges faced were shared.

This study visit was of particular interest as it provided the opportunity for an in-depth study of the German law and practice on administrative justice, in view of the legal reform perspectives in Türkiye.

 

The Joint Project on Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State is co-funded by the European Union, the Council of Europe and the Republic of Türkiye, and implemented by the Council of Europe. The Turkish Ministry of Justice - Directorate General for Legal Affairs is the end beneficiary of the Project. The Central Finance and Contracts Unit is the contracting authority of this Project.
