A total of 56 lawyers from Adana Bar Association (on 19-20 April 2024), İzmir Bar Association (on 3-4 May 2024) and Sinop Bar Association (on 3-4 May 2024) participated in the enriching two-day trainings on Procedures of Individual Application to the Constitutional Court and Binding Force and Execution of the Constitutional Court Judgments on Individual Applications. The trainings were organised in the framework of the European Union - Council of Europe Joint Project on “Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights”. They were held in the premises of the respective bar associations.
Delivered by the experienced lawyer-trainers previously trained in the training of trainers sessions held under the Project, the trainings were successful in increasing the participants’ expertise on crucial matters related to the exhaustion of the legal remedies and time-limit for lodging an individual application, manifestly ill-founded individual applications, other admissibility criteria for the individual applications before the Turkish Constitutional Court as well as binding force of individual application judgments, the consequences of their non-enforcement, and more generally, the objective and subjective impacts of judgments issued by the Constitutional Court of Türkiye.
Participants’ feedback highlighted that the trainings provided a platform for lively and engaging professional discussions. The consensus among the attendees was that they benefited greatly from explanations and discussions on topics such as the formal requirements for an individual application, the grounds for inadmissibility, the rights that cannot stand alone as subjects of an individual applications, individual application procedures and deadlines. The participants stated that the training raised awareness of unknown or little-known issues related to the procedure and that the content was practical, interactive, deepened knowledge and illustrated by practical judgments.
The Joint Project on “Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Turkish Constitutional Court is the end beneficiary of the Project.
