Mr Antonio Vercher Noguera (Spain), CCPE President, took part in the Conference on the Rule of Law in Europe organised on 9-10 December 2021 in Lisbon, Portugal, by the Association “Magistrats européens pour la démocratie et les libertés” (MEDEL), which has an observer status with the CCPE.
Mr Vercher highlighted the CCPE standards on the independence of prosecutors and relevant case-law of the European Court of Human Rights. He referred in particular to the recently adopted Opinion No. 16 (2021) of the CCPE on implications of the decisions of international courts and treaty bodies as regards the practical independence of prosecutors. The CCPE President stressed that this Opinion provides a list of useful elements which can be extracted from the relevant judgments of the European Court of Human Rights and which may impact positively the impartiality and independence of prosecutors, meaning both functional independence of individual prosecutors and institutional independence of the prosecution services. He also provided examples of how to implement the CCPE standards on independence of prosecutors in their daily work, taking into account the different systems of criminal justice in Europe.
