Possibility to obtain the negative criminal record certificates electronically

The criminal record information system managed by the Ministry of Justice stores and maintains data on criminal history of individuals and issues criminal record certificates. The certificate confirms whether or not an individual was convicted of a criminal offense. Individuals may obtain the certificate to exercise their rights - most frequently, the criminal record certificate is required in the context of job applications, project applications or obtaining a security clearance.

 

In the Republic of Slovenia, individuals have already been able to request the criminal record certificate through the electronic government service (e-Uprava), but thus far the certificate (positive or negative) was delivered to the requesting individual’s address of residency via the standard mail service.

 

As of 21 October 2019, a request may also be submitted through the electronic government service. Moreover, a negative certificate proving that an individual has not been convicted by the criminal courts in the Republic of Slovenia (a non-conviction certificate) can now also be received electronically.

 

On the other hand, a positive certificates, confirming that an individual was convicted (a conviction certificate) cannot be received electronically, as the relevant national law requires that positive certificates be delivered through registered mail only.

 

We trust that the recently introduced option to obtain the negative criminal record certificates electronically will facilitate many individuals in exercising their rights in all situations where such certificates are required, such as in the process of seeking employment.

Notaries will spend time informing and raising people's awareness of their rights in the field of civil law, succession law, contract law and family law – the new Family Code, which was introduced in Slovenia on April 2019. Also new edition of the journal "Notarski vestnik" will be issued, and there will be some appearance of notaries in media and live TV broadcast, where we will respond to the questions of the audience regarding the issues of civil law.
