The Council of Europe project “Enhancing employment rights in the Republic of Moldova” translated into Romanian the Guide on the case-law of the European Convention on Human Rights – Social Rights (hereinafter – the Guide).
The Guide in Romanian is available at the following link.
The Guide offers a comprehensive review of the ECtHR’s case law related to social rights such as employment, social security, housing, healthcare, education, and the right to an adequate standard of living.
Although the European Convention on Human Rights (ECHR) itself focuses on civil and political rights, the Court's interpretation of certain provisions, particularly in the light of the European Social Charter and other international instruments, has extended its jurisprudence into the field of social rights.
The European Social Charter complements the ECHR by specifically addressing social and economic rights, and although it is a separate instrument, the ECtHR sometimes refers to it in its judgments to support interpretations of social rights under the Convention.
The Guide is intended to help various stakeholders, including judges, lawyers, academics and policymakers, to understand how social rights are protected through the case law of the Convention. It provides practical insights into how the ECtHR applies the Convention in the context of social issues, making it a valuable resource for anyone involved in human rights litigation or advocacy.
“This Guide was translated within the framework of the Council of Europe Action Plan for the Republic of Moldova 2021-2024, and the project "Enhancing Employment Rights in the Republic of Moldova" which is co-funded by the Austrian Development Agency and the Council of Europe.”
