Training for magistrates on electoral dispute resolution on the eve of local general elections

Over 40 judges actively participated in the training on Peculiarities of examination and settlement of electoral disputes by Moldovan courts in local elections ahead of general local elections scheduled for 5 November 2023 in the Republic of Moldova.

This training was conducted to improve knowledge and practical skills of the Moldovan judges and better prepare them to examine electoral complains and settle electoral disputes.

“Following the previous trainings, organised in Sept 2020 and May 2021, respectively on the eve of the Presidential elections and earlier Parliamentary elections, the Council of Europe assisted the national partners to develop an e-learning course (first module) on the case-laws of the European Court of Human Rights in the electoral field to address the needs expressed by the magistrates who attended these 2020 and 2021 training sessions. This e-learning course is now available and hosted on ILIAS platform of the National Institute of Justice . We however thought that a live interactive training course, a few weeks prior to an election, should be maintained. In particular, prior to the upcoming elections being the first country wide elections since the new Electoral Code was adopted and especially considering the number of novelties the new code contains”,  said Mr. Franck Daeschler, deputy head of Division of Elections and Participatory Democracy in his welcome speech (online). 

The judges benefited from the knowledge and expertise of the Council of Europe international and local consultants on the good standards and European Court of Human Rights in electoral field. The training also addressed a potential range of difficult situations/disputes and provisions of the Electoral Code and the Administrative Code of the Republic of Moldova.

The training was organised in the framework of the Council of Europe Project Improving Electoral Practice in the Republic of Moldova, Phase III, in partnership with the Central Electoral Commission of the Republic of Moldova, the National Institute of Justice and the Centre for Continuing Electoral Training.
