Sexual Orientation, Gender Identity and Expression and Sex Characteristics
During its current mandate, the CDADI is instructed by the Committee of Ministers to:
- draft a Recommendation on the equality of rights of intersex persons with invited representatives of the Steering Committee for Human Rights in the fields of Biomedicine and Health (CDBIO);
- draft a Council of Europe strategy for the equality of rights of LGBTI persons (2027-2032), based on the implementation review of Recommendation CM/Rec(2010)5 and, subject to its adoption, on the Recommendation on the equality of rights of intersex persons;
- carry out a Study on the risks and impediments to the full access to rights resulting from discrimination and violence on grounds of gender expression;
- review each year a thematic dimension of Recommendation CM/Rec(2010)5 of the Council of Europe’s Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity; and
- undertake a comprehensive review of the implementation of Recommendation CM/Rec(2010)5, based on a new review methodology.
In preparation of the work on the Recommendation on the equality of rights of intersex persons, two events were held: in May 2022 a seminar organised by the Steering Committee for Human Rights in the fields of Biomedicine and Health (CDBIO) and in January 2023 a high level conference.
The third thematic report on the implementation of the Recommendation CM/Rec(2010)5 to be finalised in 2024 covers the topic “LGBTI+ persons and access to healthcare”.
Completed work
The CDADI adopted its
- First Thematic Report on Legal Gender Recognition (LGR) in Europe during its 5th plenary meeting in March 2022; the thematic report provides an overview of the state of play of national legislation on LGR, summarises the development of international standards and compiles examples of good practices to empower stakeholders in addressing the human rights concerns of LGBTI persons. It also highlights some issues for further dialogue and support from the relevant bodies of the Council of Europe and contains recommendations to the attention of the member states.
- The second thematic report finalised in 2023 covers the topic Hate Crimes and other Hate-motivated Incidents based on Sexual Orientation, Gender Identity, Gender Expression and Sex Characteristics .
