Back Finalisation of the legislative proposal for non-conviction-based confiscation in North Macedonia

The draft proposal for a legislative framework for non-conviction based confiscation was finalised during the session of the working group responsible for this process, held on 22-24 September 2021, in Skopje. The work on the legislative proposal was supported by the Action against economic crime through a guidance paper providing potential options and an overview of good practices in the area of recovering illicit assets as well as through the facilitation of the deliberations of the working group.

During the process of drafting the legal proposal, the working group identified the appropriate model of non-conviction based confiscation, the competent authorities and the institutional setup, as well as operational aspects related to the submission of the case to the civil court. The draft sets out the procedure for investigation and prosecution related to property of unexplained origin. Following the finalisation of the draft, the Action will review and provide recommendations in line with international good practices.

The Council of Europe/European Union Horizontal Facility II - Action against Economic Crime in North Macedonia will continue to support beneficiaries through its technical assistance and expertise.
