Back Workshop on reasoning of decisions in disciplinary matters organised for representatives of the prosecution system of the Republic of Moldova

On 9 July 2021, representatives of the Superior Council of Prosecutors and General Prosecution Office attended an online workshop on reasoning of decisions in disciplinary proceedings. During the event, the participants discussed with the Council of Europe experts the shortcomings identified in the process of disciplinary proceedings and ways to improve the legal reasoning of decisions, according to the findings and recommendations of the Group of States against Corruption (GRECO) issued in the Fourth Evaluation Round and Second Compliance Report on the Republic of Moldova.

The need to review the framework on the disciplinary liability applicable to prosecutors was one of the main recommendations made by GRECO regarding the Republic of Moldova. More precisely, GRECO mentioned that additional measures need to be taken to strengthen the objectivity, efficiency and transparency of the legal and operational framework for the disciplinary liability of prosecutors. GRECO also referred to the need to improve the justification of the decisions issued in disciplinary cases.

In his opening speech, Mr William Massolin, Head of the Council of Europe Office in Chisinau, mentioned that additional efforts should be made in order to improve the understanding of the society of the acts issued in disciplinary cases in regard to prosecutors through transparent and effective procedures.

The workshop’s discussions and recommendations addressed the following subjects:

  • Good practices and standards regarding legal reasoning of decisions in disciplinary proceedings;
  • Relevant comparative law applicable in disciplinary proceedings;
  • Ways to standardize the acts drafted up by the Prosecutorial Inspection and Disciplinary and Ethics Board in the context of disciplinary verifications.

This activity was organized within the framework of the project “Action against corruption in the Republic of Moldova”, funded by the Bureau of International Narcotics and Law Enforcement Affairs (INL) of the US Department of State and implemented by the Council of Europe.
