The decision on the merits in Syndicat des Agrégés de l’Enseignement Supérieur (SAGES) v. France, Complaint No. 211/2022, is now public

The decision of the European Committee of Social Rights (ECSR) on the merits in Syndicat des Agrégés de l’Enseignement Supérieur (SAGES) v. France, Complaint No. 211/2022, became public on 15 October 2024.

In its complaint, the complainant organisation alleged that French legislation (Article L 232-3 of the Education Code) depriving tenured lecturers (commonly known as PRAGs for professeurs agrégés) and temporary assistant lecturers (ATERs for attachés temporaires d'enseignement et de recherche) of the right to vote and stand for election to the disciplinary board of the National Council for Higher Education and Research (Conseil national de l’enseignement supérieur et la recherche (CNESER)) is in violation of Article 22 (the right to take part in the determination and improvement of the working conditions and working environment) and of Article E (non-discrimination) read in conjunction with Article 22 of the revised European Social Charter (“the Charter”).

In its decision on the merits, the ECSR concluded:

-    by 14 votes to 1, that there is no violation of Article 22 nor of Article E read in conjunction with Article 22 of the Charter. 

In accordance with Rule 35§1 of the Rules of the Committee, a separate dissenting opinion was appended to the decision.
