The decision of the European Committee of Social Rights on the merits of the complaint Confederazione Generale Italiana del Lavoro (CGIL) v. Italy (No. 140/2016) became public on 7 June 2019.
In its complaint CGIL alleged that members of the Guardia di Finanza do not enjoy trade union rights, in violation of Articles 5 (the right to organise) and 6 (the right to bargain collectively) of the Revised European Social Charter
The European Committee of Social Rights adopted its decision on the merits on 22 January 2019.
In its decision on the merits, the Committee concluded:
- by 9 votes to 2 that there is a violation of Article 5 of the Charter;
- unanimously, that there is no violation of Article 6§1 of the Charter;
- unanimously, that there is a violation of Article 6§2 of the Charter;
- by 9 votes to 2, that there is a violation of Article 6§4 of the Charter.
