The European Committee of Social Rights (ECSR) adopted during its 338th session (4-8 December 2023):
The complaint was registered on 30 May 2023. It relates to Article 6§4 (the right to bargain collectively) of the Charter. The complainant organisation alleges that the total prohibition against the right to strike of Police members is not a restriction strictly necessary to ensure public safety and amounts to a violation of their right to take collective action under Article 6§4 of the Charter.
The ECSR unanimously declared the complaint admissible on 5 December 2023.
The complaint was registered on 19 June 2023. It relates to Articles 11 (the right to protection of health) and 13 (the right to social and medical assistance) as well as Article E (non-discrimination) in conjunction with each of the aforementioned provisions of the revised European Social Charter. The complainant organisations allege that in Sweden, vulnerable EU migrants, including Roma citizens of other European Union countries, are regularly denied necessary healthcare, are charged the full cost of such care or end up refraining from seeking necessary health care as a result of the dissuasive effect of the two above-mentioned factors, in breach of the aforementioned provisions of the Charter.
The ECSR unanimously declared the complaint admissible on 6 December 2023.
