Legal gender recognition in North Macedonia

The Execution Department took part in the peer to peer study visit to Malta from 12 to 14 February which was organised by the Council of Europe SOGI Unit in cooperation with  the authorities of North Macedonia and of Malta. The study visit was part of the North Macedonia authorities’ plan to implement the European Court’s 2019 judgment in the X. case, which concerns legal gender recognition and will be examined by the Committee of Ministers during its Human Rights meeting of 3-5 March.

The study visit provided an opportunity for the Maltese authorities to share their best practices in the context of their efforts to reduce discrimination on the grounds of gender identity and introduce legislation which is Convention compliant. The authorities of North Macedonia appreciated this exchange which will facilitate the preparation and introduction of legislation necessary to implement the Court’s judgment. It is noted that a representative of the civil status registry authorities of North Macedonia dealing with the applicant’s casefile also took part in the study visit. The proceedings aimed at obtaining a new sex marker on the applicant’s birth certificate started in 2011 and are still pending.
