On 28 March, the Department for the Execution of Judgments participated in Chișinău at the fifth meeting of the Advisory Council of the Government Agent of the Republic of Moldova. The Advisory Council is composed of the Government Agent and representatives of the relevant national authorities, the Ombudsperson, academia and civil society. Its main goal is to contribute to timely and effective implementation of the European Court’s judgments concerning the Republic of Moldova, through co-ordinated action of all national actors concerned and by ensuring the necessary support at the highest political level.
At its fifth meeting, the members of the Advisory Council discussed a number of issues pending before the Committee of Ministers, notably lack of effective investigations into deaths and ill-treatment committed by private individuals (Răilean group), as well as ill-treatment or torture in police custody (Levința group), and unlawful and arbitrary detention in psychiatric hospitals (Gorobeț and David group).
Furthermore, the Department for the Execution of Judgments provided a follow-up for the authorities after the Committee of Ministers’ first examination of the V.I. case which discloses a systemic problem of involuntary placement in a psychiatric hospital and psychiatric treatment of children with intellectual disabilities and without parental care. It also provided a follow-up after the first examination of G.M. and Others, concerning forced abortions and birth control measures imposed on victims of rape with intellectual disabilities.
Finally, the Advisory Council discussed the individual and general measures required in the three recent judgments delivered by the European Court (E.T., I.C. and Clipea and Grosu) which raise multiple issues under mental health dimension.
