On 24 November 2022, the European Committee on Legal Co-operation (CDCJ) approved the publication of a comparative study examining the interplay between artificial intelligence (AI) and administrative law, prepared by Prof. Dr. Johan Wolswinkel (Tilburg University, the Netherlands).
The study examines, on the basis of responses from 24 member States of the Council of Europe, the state of legislation regulating AI in administrative decision-making, identifying general patterns and different approaches. The use of AI in the public sector raises a number of legal issues, including whether the existing rules and principles of administrative law are sufficient to regulate this new form of decision-making.
This study contributes to the work undertaken by a limited working group of the CDCJ (CDCJ-ADMIN-AI), and is aimed to support the reflections on future work of the Committee in this area, as well as the revision of the handbook “The Administration and You”.
