The EU and the Council of Europe continue to support Montenegro in advancing judicial independence to reinforce the justice system and advance the European integration, including through the development of a dedicated law regulating the salaries and other material rights of judges and prosecutors, including Constitutional Court judges. This initiative aims to further strengthen the financial independence of the judiciary, in line with European standards and the Venice Commission’s recommendations from 2024.
Montenegro is taking significant steps towards ensuring that financial conditions for judges and prosecutors are adequate, fair, and aligned with European best practices. The Working group has been established by the Ministry of Justice in December 2024, to develop the new Law and ensure a transparent and sustainable framework for determining judicial salaries and benefits. Working group meetings are under way to draft the legislation and ensure that it guarantees financial stability for judicial officeholders while preserving the independence of the judiciary from political or economic pressures.
The action "Strengthening accountability of the judicial system and enhancing protection of victims' rights in Montenegro" which is part of the joint European Union and the Council of Europe Programme “Horizontal Facility for the Western Balkans and Türkiye" is actively supporting the Ministry of Justice and the Working group in this process, providing technical assistance and facilitating dialogue among key national stakeholders. Additionally, a comprehensive compilation of relevant international and European standards has been prepared to support the Working Group’s efforts, ensuring that the Law is aligned with established norms and best practices.
The development and adoption of the Law will support broader judicial reform efforts aimed at strengthening the rule of law and ensuring compliance with European standards, for the benefits of citizens.
