The joint CoE/EU project "Support for the Implementation of the Judicial Reform in Serbia", in cooperation with the Supreme Public Prosecutor’s Office, organised the Workshop on harmonisation of prosecutorial practices as an effective method for the prevention of conflicting case law. The workshop brought together prosecutors from Romania, Slovenia, Austria, Bulgaria, Portugal, and more than 20 public prosecutors from all parts of Serbia, as well as representatives of the EU Delegation in Belgrade.
An International Council of Europe expert presented the key findings of the comparative analysis of the mechanisms for harmonisation of prosecutorial practice in Council of Europe member states performed under the project. The prosecutors from Council of Europe member states engaged in a dynamic discussion centred on best practices, problems encountered in practice, and different approaches to the issue of caselaw harmonisation. An array of different formal and informal approaches showcased the universality of challenges in caselaw harmonisation among Council of Europe member states and gave an opportunity to Serbian prosecutors to increase their knowledge and present mechanisms used in Serbia to international colleagues.
In the second part of the workshop, Serbian prosecutors had an opportunity to work in groups on case studies, together with visiting prosecutors and use various possible methods of caselaw harmonisation to reach the best possible solution. The workshop was an excellent occasion for a dialogue and joint work, highlighting the importance of caselaw harmonisation in achieving legal certainty. The joint CoE/EU project "Support for the Implementation of the Judicial Reform in Serbia" will continue to support the work of the prosecution service on caselaw harmonisation and improvement to the prosecutorial caselaw database.
