The main objective  of the project  is to make the general population in Bosnia and Herzegovina benefit from quality and human rights compliant judicial system.

EXPECTED OUTPUTS AND RESULTS

The Project will contribute to the protection of human rights and strengthening domestic human rights protection mechanisms in Bosnia and Herzegovina in line with European human rights standards. In particular, the Project will focus on further strengthening national mechanisms for the national case-law harmonisation and implementation of the European Convention on Human rights (ECHR) standards, including the proper execution of the judgments of the European Court of Human Rights (ECtHR). A dialogue among relevant actors of the execution process will be facilitated in order to ensure optimal solutions for the execution of the judicial decisions of national courts, focusing on the position of the Government Agents (GAs) as de facto coordinators on the national level. In addition, the Project will contribute to improving the quality of justice through human-rights oriented adjudication facilitated with tailor-made capacity-building.

Finally, the project will continue supporting Law faculties and law students in mainstreaming human rights approach and interactive technics in legal education.

HJPC Delegation Learns from Lithuania’s Judicial Reforms

A delegation from the High Judicial and Prosecutorial Council (HJPC) of Bosnia and Herzegovina recently concluded a successful two-day study visit to Lithuania on June 11-12, 2024. During the visit, they engaged in detailed discussions and gained valuable insights into several key aspects of the Lithuanian judicial system.

The delegation was inspired by the successful reforms in the Lithuanian judicial system, which have led to greater transparency and efficiency, including improved accountability of judges. Some of the key measures include:

  • Case Management System: A developed case management system that allocates cases across the country, making the territorial jurisdiction of the courts non-applicable.
     
  • Uniformity in Case Law: The appellate court ensures uniformity in internal case law, with final decisions made by the Supreme Court.
     
  • Commissions with Public Involvement: Established commissions in various areas of judicial interest include distinguished public members, such as journalists.
     
  • Court Reorganisation: Doubling the number of legal advisors relative to the number of judges has significantly contributed to eliminating the case backlog.

These reforms have collectively enhanced the Lithuanian judicial system, serving as a valuable model for Bosnia and Herzegovina.
