Judicial protection of political and civil rights and freedoms in pre-war, war and post-war period in the focus of discussions at the VII International Conference “Administrative Justice in Ukraine: Issues of Theory and Practice”

On 4 – 5 July 2024, VII International Conference “Administrative Justice in Ukraine: Issues of Theory and Practice” was organised in the city of Ostroh at the National University of Ostroh Academy with focus on issues of judicial protection of political and civil rights and freedoms in pre-war, war and post-war period. The Conference was organised within the framework of the Days of Administrative Justice in Ukraine by the Administrative Court of Cassation within the Supreme Court in cooperation and with the support of the Council of Europe, as well as other international and national partners*.

The Conference brought together more than 100 participants, including representatives of the national judiciary of Ukraine, foreign courts and international judicial bodies, members of the Parliament of Ukraine, representatives of the Central Election Commission, profile ministries and agencies of Ukraine, academia and profile civil society organisations, as well as representatives of international organisations.

The participants of the Conference, amongst other, discussed the issues of protection and restriction of freedom of association in political parties and civil organisations, exercise of the right to peaceful public assemblies, as well as pre-requisites and challenges for the organisation and conduct of post-war elections.

Within the framework of the Conference, respective thematic contributions were made by international experts and representatives of the Council of Europe. Particularly, during the discussion of issues pertaining to the protection and restriction of freedom of association in political parties and civil society organisations, exercise of the right to peaceful public assemblies, Mr Kaarlo TUORI, Honorary President of the Venice Commission of the Council of Europe, highlighted respective international and European standards and specificities of their implementation with regard to the challenges brought by the war. Herewith, Mr Dmytro TRETYAKOV, Senior Lawyer of the Registry of the European Court of Human Rights, presented an overview of respective case-law of the European Court of Human Rights regarding permissible restrictions on the right to freedom of association in the interests of the national security. During the discussions dedicated to pre-requisites and challenges for the organisation and conduct of post-war elections, Mr Duro SESSA, Judge of the Supreme Court of the Republic of Croatia, contributed with an overview of the main challenges and lessons learned for the Republic of Croatia concerning the conduct of post-war elections (more about respective experience can be found in analytical overview).
