The conclusions of the European Committee of Social Rights regarding Ukraine for 2023 available in Ukrainian

The conclusions of the European Committee of Social Rights regarding Ukraine for 2023 have been translated into Ukrainian within the Council of Europe project  “Enhanced social protection in Ukraine”.

The European Committee of Social Rights is a monitoring body in the European Social Charter system. The function of the European Committee of Social Rights is to rule on the conformity of the situation in States with the European Social Charter. In respect of national reports, it adopts conclusions; in respect of collective complaints, it adopts decisions. Non-conformity conclusions highlight important aspects that require further attention and adjustments to achieve full compliance with the standards of the European Social Charter.

In the conclusions regarding Ukraine for 2023, the European Committee of Social Rights assessed situations based on the national report covering the period 2018-2021 under Thematic Group IV: "Children, Families, and Migrants". This group includes the following provisions:

  • The right of children and adolescents to protection (Article 7),
  • The right of employed women to maternity protection (Article 8),
  • The right of the family to social, legal, and economic protection (Article 16),
  • The right of mothers and children to social and economic protection (Article 17),
  • The right of migrant workers and their families to protection and assistance (Article 19, which is not accepted by Ukraine),
  • The right of workers with family responsibilities to equal opportunities and treatment (Article 27),
  • The right to housing (Article 31).

The conclusions regarding Ukraine for 2023 concern 23 situations and are as follows: 5 conclusions of conformity with the Charter's requirements and 18 conclusions of non-conformity. When formulating its conclusions, the European Committee of Social Rights took into account the comments from the Secretariat of the Ukrainian Parliament Commissioner for Human Rights, submitted for the first time in the form of an alternative report.

National report for 2023 was the last national report submitted under the old reporting procedure to the European Committee of Social Rights, which divided the rights under the European Social Charter into four groups with annual reporting on one of the four groups of rights.

The reform of the European Social Charter system has introduced an updated reporting procedure since 2024. Thus, Parties will submit national reports every two years, covering one of two groups of rights under the European Social Charter. These changes aim to enhance the efficiency of monitoring under the Charter.

The Council of Europe project "Enhanced social protection in Ukraine" is implemented within the Council of Europe Action Plan for Ukraine "Resilience, Recovery, Reconstruction" for 2023-2026. It aims to ensure that persons from vulnerable groups, in particular, the population affected by the war, enjoy a higher level of social rights and social protection.
