Ukrainian prosecutors gained insight into international standards governing admissibility of electronic evidence of war crimes and other offences

The Training Centre of the Prosecutor General’s Office of Ukraine and the CyberUA project have teamed up to train a group of 26 prosecutors from different services and regions on the admissibility of electronic evidence of war crimes and gross human rights violations committed in the course of Russian aggression against Ukraine. The training was held in Chernivtsi region in September 2024.

The Council of Europe experts, with aid of the trainer designated by the Prosecutor General’s Office of Ukraine, covered different aspects of the nature and specifics of electronic evidence, especially ones coming from the open sources or beyond the criminal procedures. Irrespective of the origin and specifics, the Convention on Cybercrime (Budapest Convention) and its related standards remain highly relevant to collection and handling of electronic evidence in the context of war crimes and gross human rights violations committed in the course of the Russian aggression.

This particular training goes to the core of the matters addressed by CyberUA project: to ensure that criminal justice professionals understand requirement inherent in processing electronic evidence and are able to apply it properly to ensure the chain of custody. This knowledge will assist Ukrainian prosecutors to improve their processing of criminal cases that rely on electronic evidence, in particular war crimes and gross human rights violations. The tools offered by the Budapest Convention and its related standards are key to both ensuring compliant legislation and regulations, but also for practical application in criminal investigations and prosecutions.

These training sessions will be further updated and rolled out in different regions of Ukraine through the duration of the CyberUA project.
