Round table “Property Rights of Internally Displaced Persons in Ukraine”

On 23 March, in Kyiv, a round table “Property Rights of Internally Displaced Persons in Ukraine” has been organized on the initiative of the Court Chamber for the Protection of Social Rights of the Administrative Court of Cassation within the Supreme Court of Ukraine.

Participants of the event were welcomed by Mr Mykhailo Smokovych, Head of the Administrative Court of Cassation and Mr Mykola Gimon, Secretary of the Court Chamber for the Protection of Social Rights of the Administrative Court of Cassation.

The round table was attended by judges, representatives of the Government Agent before the European Court of Human Rights, the Representation of the President of Ukraine in Autonomous Republic of Crimea, the United Nations Human Rights Monitoring Mission in Ukraine, Council of Europe, OSCE, UNHCR, Housing, Land and Property Technical Working Group (Protection cluster), as well as leading national NGOs.

During the event, the issues of ensuring property rights on the conflict-affected territories, protection of property rights of IDPs in compliance with European and international standards, as well as the necessity of developing administrative mechanisms for the compensation of property damage caused to owners as a result of the conflict were discussed.

Ms Ganna Khrystova, Senior Project Officer of the Council of Europe Project “Strengthening the Human Rights Protection of IDPs in Ukraine” (2015-2017) presented key points of PACE Resolution 2198 (2018) “Humanitarian Consequences of the War in Ukraine”, as well as selected case-law of the European Court of Human Rights, related to the protection of property rights of IDPs. Representatives of UN agencies, international organizations and the civil society have delivered clear ad consolidated message on the importance of applying humanitarian and international law approaches to the protection of IDPs in Ukraine.

In particular, the need to delink the right to pensions from the status of an IDP and the development of efficient administrative compensation and restitution tools for the property destroyed during the conflict.

The Council of Europe Project “Strengthening the Human Rights Protection of IDPs in Ukraine” (2015-2017) has collected and published on its page https://www.coe.int/en/web/kyiv/idps a wide range of informational materials that facilitate access to Council of Europe standards for professionals working in Ukraine.
