Project title: Support to development of the constitutional justice in Ukraine

The project focus and expected results
  • The Constitutional Court strengthened capacity contributes to the delivery of constitutional justice through an increased quality of legal interpretation with due regard to the standards of the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union;
  • Constitutional Court of Ukraine equipped with and starts to apply the best practices of its European counterparts.
Project objective

The project aims at the development of constitutional justice in Ukraine, fostering expertise and exchange of experience, as well as promotion of dialogue between the Constitutional Court of Ukraine and a constitutional court from an EU Member State, building capacities of the Court regarding the coherent interpretation of human rights standards, doctrines, and principles, based on methodologies and approaches of interpretation applied by ECtHR and ECJ.

Project approach and activities

The project aims at the development of constitutional justice in Ukraine, fostering expertise and exchange of experience, as well as promotion of dialogue between the Constitutional Court of Ukraine and a constitutional court from an EU Member State, building capacities of the Court regarding the coherent interpretation of human rights standards, doctrines, and principles, based on methodologies and approaches of interpretation applied by ECtHR and ECJ.

Project implementation will involve elements of the EU twinning instrument to share best practices of constitutional justice developed in a selected EU state. The project will ensure a close exchange of experience and knowledge, as well as dialogue opportunities for judges and staff of the Constitutional Court of Ukraine with its European counterpart both on matters related to organisational structure and working procedures relevant for the functioning of the Court, as well as specialised knowledge for better delivery of constitutional justice in Ukraine.

The key target stakeholders of the project are the Constitutional Court of Ukraine as a specialised court with jurisdiction over constitutional matters, in particular - judges of this court, judicial assistants, the secretariat.

The methodology of project implementation will involve provision of expertise and delivery of dialogue and capacity building activities.   

The main types of activities include: 

  • provision of international and national expertise; 
  • delivery of dialogue and capacity building activities; 
  • organisation of study visits; 
  • technical consultations and discussions of the Constitutional Court of Ukraine with the Council of Europe bodies, including the Department for the Execution of Judgments of the ECtHR; 
  • development of coordination mechanisms with the Council of Europe bodies, including the Venice Commission and Department for the Execution of Judgements. 

Based on the provided capacity-building support to the Constitutional Court judges in coherent and harmonized interpretation of human rights standards, doctrines and principles, by exploring methodologies and approaches of interpretation applied by the European Court of Human Rights and the European Court of Justice for the legal instruments, the project envisages a conduction of expert analysis of the judgements of the Constitutional Court of Ukraine to measure enhanced capacity of judges.

About the PGG

* While the Partnership for Good Governance does not include activities with the participation of the Belarusian authorities, activities may be organised with the representatives of Belarusian civil society and democratic forces as appropriate in line with the European Council Conclusions of February 2022 and the Decision of the Council of Europe Ministers’ Deputies of March 2022.
