Proactive Investigation and effective prosecution of cases of trafficking with focus on migrants’ published in North Macedonia

In order to respond to the need of security and legal practitioners to provide adequate criminal law response to the risks of trafficking that migrants might be subjected to, the EU and Council of Europe anti-trafficking action in North Macedonia developed the publication “Proactive Investigation, Effective Prosecution and Adjudication of Cases of Trafficking in Human Beings with Focus on Migrants at Risk from Trafficking In Human Beings”. It is a practical tool in the hands of professionals in the field on how to proactively investigate and identify human trafficking victims, collect evidence and build indictments against traffickers, in line with European standards and best practices. It further clarifies the procedural protection during criminal proceedings the trafficking victims are entitled to. A special chapter is devoted to the case-law of the European Court on Human Rights regarding state obligations to investigate and prosecute trafficking cases, as well as protect human trafficking victims among migrants.

The publication provides perspectives of police investigators, prosecutors, judges and legal representatives of the victim. It explains the applicable procedures step-by-step in accessible way to the professionals responsible to prevent and fight trafficking in human beings.

The publication was commissioned by the action “Strengthening anti - trafficking action in North MacedoniaStrengthening anti - trafficking action in North Macedonia”, part of the of the European Union and Council of Europe joint initiative “Horizontal Facility for the Western Balkans and Türkiye”.
