CDCJ: Guide for practitioners on the administrative detention of migrants and asylum seekers

The European Committee on Legal Co-operation (CDCJ) published its Guide for practitioners on the administrative detention of migrants and asylum seekers which aims to promote the application of existing international and European standards in this area. This guide was drawn up by the CDCJ for professionals working in the field of migration, as a practical tool that will help to improve their ability to effectively and adequately prevent any risk and any form of abuse or violation of the rights of persons placed in administrative detention, and to strengthen respect for their dignity and fundamental rights.

In addition, as a contribution to the Council of Europe Action Plan on Protecting Vulnerable Persons within the context of migration and asylum (2021-25) and the Council of Europe Strategy for the Rights of the Child (2022-2027), the CDCJ adopted at its 101st plenary meeting (15 – 17 November 2023) new terms of reference of its  working group on migration (CDCJ-MIG) for (i) the preparation of a compendium of good practices in respect of legal aid and representation, access to information and to justice for children in procedures relating to the determination of nationality or statelessness (2024-2025); and (ii) the preparation of a non-binding legal instrument regarding stateless children’s access to nationality, including guidance on child-sensitive procedures relating to the determination of nationality or statelessness (2025-2026), based on the outcome of a feasibility study to be prepared in 2024.
