Overview of the practice of the European Committee of Social Rights and the European Court of Human Rights

Protection of social and economic rights is an important part of the national legislation and Constitution of Georgia. Despite the legislative and institutional changes implemented in the last couple of years, challenges remain in the field of protection of rights in labour relations. It is important to raise awareness of representatives of state and non-state organisations about the European Social Charter and the rights and guarantees recognised and protected by it. In addition, discussion and generalisation of the practice of the European Committee of Social Rights and the European Court of Human Rights in the field of labour, right to employment, equal opportunities and professional training is also important.

On June 28, 2023, a workshop was held for the employees of the Office of the Public Defender of Georgia and relevant non-governmental organisations on the topic: the practice of the European Committee of Social Rights and the European Court of Human Rights in the direction of creating employment/equal opportunities and realising the right to work.

As a result of the workshop, the attendees were given information about the impact of the Social Charter in Georgia, as well as about the rights protected by the Charter and Georgian legislation in the field of labour/employment (including: access to employment; equal labour opportunities, etc.). At the training, in an interactive mode, a discussion and a generalisation of the practice of the European Committee of  Social Rights and the European Court of Human Rights was held in terms of labour, right to employment, equal opportunities and professional training. As a result of participating in the training, the participants learned more about the case law of the European Committee of Social Rights and will be able to use it more purposefully in their daily activities.
