Statement by Mr Gianni Buquicchio, President of the Venice Commission

I came to Tirana upon the invitation of the institute of Diplomatic Studies (IDS) to participate in two conferences organised by the European University of Tirana and by the IDS.

I had also very fruitful discussions with representatives of the state institutions, with political personalities of both the majority and the opposition, with the constitutional court, with the academia and with the diplomatic community. I have thus had the possibility to get a clearer understanding of the situation here in Albania.

I have discussed two main issues: the reform of the judiciary and the decriminalisation of parliament.

The judicial reform is a high priority for Albania; it is indispensable in order to enable a democratic and economic development, as well as EU integration. A viable, long-lasting reform can only be achieved on the basis of a constructive and responsible dialogue between the parliamentary forces and with sufficient consultations with the civil society and with national and international experts.

Time is of essence, but reforms should not be rushed, nor procrastinated. The Venice Commission has agreed to participate in the work of the Ad Hoc Parliamentary committee for the reform of the judiciary.

The decriminalisation of parliament may be achieved through a legislative reform to be applied to future elective bodies. The Venice Commission is ready to assist by organising an exchange of views between the Albanian political forces and international experts from countries with relevant experience in this field.

The aim of these reforms is to promote the advancement of the Albanian society. The currently prevailing divisive and confrontational political culture should be overcome with a view to reaching this objective.
