Back Moldova, Republic - Amicus Curiae Brief on the criminal liability of constitutional court judges

0967/2019

Requested by: Republic of Moldova, Constitutional Court, President

Measures taken: The Constitutional Court found, inter alia, that Constitutional Court judges enjoy functional immunity under Article 137 of the Constitution and cannot therefore be held liable for votes and opinions expressed in the exercise of their functions – which extends to after their term of office has ended. They can also not be held criminally liable for offences committed in cases not related to the realisation of constitutional justice.
