Indietro No. 160/2018 Confédération Générale du Travail Force Ouvrière (CGT-FO) v. France

The complaint was registered on 12 March 2018. It relates to Article 24 (right to protection in cases of termination of employment) of the Revised European Social Charter. CGT-FO alleges that the Order No. 2017-1387 of 22 September 2017 which introduced a ceiling on the amount of compensation that may be awarded to an unlawfully dismissed employee, is contrary to the above-mentioned provision of the Charter in that it excludes the worker from claiming a higher amount of damages which he/she may have suffered due to the dismissal.
