The complaint was submitted in 2022 by an individual on behalf of the NGO World and the Danube, and alleges that illegal construction work and insufficient implementation of regulations by state institutions in Kamenička ada, Dunavac and Šodroš endanger more than 200 strictly protected flora, fauna and funghi species under national law.
Examples for such species that are also strictly protected or protected under the Bern Convention are the Smew (Mergellus albellus), the Tufted duck (Aythya fuligula) and the Saker Falcon (Falco cherrug), but the complainant also sees the integrity of the ecosystem of these sites as a whole endangered. According to the complainant, an adoption of a Government Conclusion from 2020 allows for the construction of a road facility that will lead to drastic changes and irreversible destruction in that habitat. Additionally, a public Water Management Company has allegedly issued an approval for constructing an embankment in the water floodplain of Kamenička ada.
Following the complainant, in 2021 the NGO World and the Danube together with others started an initiative for the protection of the Danube, Kamenička ada, Šodroš and Ribarsko ostrvo addressing the Provincial Institute for Nature Protection, but the Initiative was rejected for financial reasons in the period 2021/2031. Further legal actions by the NGO World and the Danube to protect the areas mentioned above allegedly resulted in no further positive result, which is the reason for the complainant to forward the issue to the Bern Convention.
