3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui.
Les procédures de PMA sont couvertes par le Système national de soins de santé, une part restant à la charge du patient. La policlinique où la procédure de PMA est mise en œuvre est financée comme suit :
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui.
Tous les femmes/couples qui se voient proposer une bénéficient d’une prise en charge partielle des médicaments et des frais de traitement pour les traitements de FIV/ICSI. La décision de proposer ou non un traitement sera prise sur la base des critères suivants :
La première étape consistera pour la femme/ le couple à consulter le médecin de famille. Après évaluation médicale et psychosociale du couple, le médecin décidera d’orienter ou non la femme/le couple vers l’un des centres pratiquant la PMA.
Le médecin de la clinique décide si la femme/le couple se verra proposer la PMA ou non. Selon la loi sur la biotechnologie, une clinique proposant la PMA doit obtenir une autorisation ou un agrément de la direction de la santé.
Pour avoir accès à la PMA par le biais des cliniques financées par le système national de soins de santé, une évaluation de la rentabilité présumée du traitement pour la femme/le couple est effectuée.
De nombreux centres ont établi des lignes directrices pour l’évaluation des couples demandant à bénéficier d’une assistance médicale à la procréation.
Les femmes/couples peuvent également choisir de payer pour un traitement dans des cliniques privées, ce qui peut permettre de raccourcir le temps d'attente, et ces cliniques ne sont pas liées par les mêmes principes de rentabilité.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Oui. La prise en charge financière est limitée à trois procédures de PMA (trois procédures de FIV ou d’ICSI - ou une combinaison, lorsqu’une procédure inclut le prélèvement d’ovules). Le transfert d’embryons congelés (TEC) n’est pas comptabilisé comme une « procédure de PMA ».
2. Des critères spécifiques sont-ils retenus pour l’accès à la PMA ?
Raisons médicales :

Les critères d'accès à la FIV sont l'infertilité ou le fait que la femme soit atteinte ou porteuse d'une maladie héréditaire grave.
Les couples lesbiens et les femmes célibataires ont accès à la PMA par insémination ou à la FIV. Les critères d'accès à la procréation assistée par insémination pour les couples hétérosexuels sont l'infertilité ou le fait que l'homme soit atteint ou porteur d'une maladie héréditaire grave :
La loi ne prévoit pas de droit au traitement dans les cas où il existe un risque de transmission de maladies, par exemple entre la femme et son mari/conjoint.
En ce qui concerne la situation où l'un ou les deux partenaires sont atteints d'une infection sexuellement transmissible grave et chronique : Lorsque la femme est infectée, une évaluation du risque de transmission du virus à l'enfant doit être faite dans chaque cas avant de décider de poursuivre.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.
Les critères d'infertilité pour l'accès à la FIV ne s'appliquent pas dans les cas où un couple de même sexe se fait traiter par don de partenaire (l'une des femmes donne son ovule à l'autre qui porte l'enfant).

20. Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire. Non.

17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui/pour les parents Non/pour un tribunal ? Non. Les enfants nés d’un don de sperme ont le droit de connaître l’identité du donneur lorsqu’ils atteignent l’âge de 15 ans (ou 18 ans pour ceux nés d'un don de sperme avant 2021).
En particulier :

Pour les donneurs recrutés en Norvège, les parents seront informés des critères généraux de sélection d’un donneur (bonne santé physique et mentale, aucune maladie héréditaire grave ; ainsi que le régime de tests effectués), mais n’auront aucune autre information sur le donneur. La Norvège autorise l’importation de sperme ou d’oocytes à partir de banques de sperme établies à l’étranger, uniquement si celles-ci disposent d’un système ouvert d’information sur les donneurs, conformément aux directives européennes applicables. Les ovocytes ne peuvent être importés que d'autres pays nordiques.
c. Autres informations: Pour l’enfant lui-même Oui/pour les parents Non/pour un tribunal ? Non. A l'âge de 15 ans (ou 18 ans, voir texte précédent), l’enfant peut obtenir des informations sur l’identité du donneur (nom et adresse tels qu’enregistrés dans le registre norvégien et, si nécessaire, la date de naissance et le numéro d'identité nationale). Ce sont les seuls renseignements qui lui seront fournis.
18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Oui.

Les embryons donnés ne peuvent être utilisés qu'à des fins de recherche in vitro, et non pour la reproduction assistée.
L'utilisation simultanée d'un ovule et d'un sperme donnés n'est pas autorisée. Une exception a été faite pour les couples de lesbiennes afin qu'un ovocyte puisse être prélevé sur l'une des femmes, fécondé avec le sperme d'un donneur et que l'embryon résultant soit implanté dans l'utérus de l'autre femme du couple.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. Les directives nationales fixent le montant maximal de l'indemnisation des donneurs. Outre les frais de déplacement documentés, les donneurs de sperme peuvent recevoir 750 NOK et les donneurs d'ovocytes 5300 NOK par don. Les montants ont été fixés afin de dédommager les donneurs pour le temps qu'ils consacrent au don et les éventuels désagréments qu'il entraîne.

Pour empêcher l’utilisation de sperme prélevé sur des donneurs malades et veiller à ce que les renseignements sur le donneur (nom, adresse) puissent être transmis à l’enfant lorsqu'il atteigne l'âge de 15 ans, le donneur doit avoir la citoyenneté norvégienne ou posséder un permis de résidence permanente.
Un entretien sera organisé avec le donneur pour s’assurer la décision du donneur a la maturité et la motivation altruiste nécessaires et de s'assurer que le donneur comprend les conséquences et est informé que les futurs enfants peuvent prendre contact. Le donneur doit donner son consentement écrit. Si le consentement est retiré, les spermatozoïdes/ovocytes non utilisés doivent être détruits.
Le don d’embryons est interdit.
L’évaluation des donneurs suit les procédures et critères établis par les Directives de l’UE sur les tissus et les cellules.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. La loi sur la biotechnologie exige que le médecin traitant choisisse un donneur approprié. Il est recommandé que le médecin choisisse un donneur qui a une ressemblance physique étroite avec les futurs parents. Les donneurs ne doivent pas être choisis en fonction d'autres critères.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui.
Un registre national des donneurs a été créé pour permettre aux enfants conçus en Norvège grâce à un don de sperme ou d'ovocytes de connaître l'identité du donneur lorsqu'ils atteignent l'âge de 15 ans (ou 18 ans pour ceux nés de gamètes donnés avant 2021),
Le sperme d'un donneur peut être utilisé par 6 familles au maximum, ceci est précisé dans le formulaire de consentement. Le nombre de cycles de don pour une donneuse d'ovocytes est limité à 3. Il n'y a pas de nombre maximum de familles.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Des règles relatives au statut de parent de la deuxième mère (celle qui ne donne pas naissance à l’enfant) ont été établies.
