6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui / d’ovocyte ? Oui / c. d’embryon ? Oui
Le don de gamètes (sperme et ovocytes) et d’ovules fécondés (uniquement les ovules fécondés surnuméraires) n’est autorisé qu’avec le consentement du donneur.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. Selon la Loi 3305/05 (article 8, paragraphe 1) « Toute rémunération ou indemnité pour un don de gamètes et d’ovule fécondé est interdite. Cependant, les frais médicaux, les soins ou les frais de laboratoire, les frais de déplacement et d’hébergement, ainsi que l’absence au travail, peuvent donner lieu à un dédommagement ».
L’Autorité nationale pour la PMA a adopté par la suite une décision (Décision n°36, Journal officiel 670 B’ 16.4.2008) qui prévoit une compensation pour les frais médicaux, les soins et les frais de laboratoire engagés avant et après le don. Les frais d’hébergement et de transport peuvent également faire l’objet d’une compensation. Ce montant ne doit pas dépasser 200 € pour un don de sperme et 600 € pour un don d’ovocyte. Une compensation pour absence au travail est également possible.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui / d’ovocyte ? Oui / d’embryon ? Oui
Les donneurs doivent avoir atteint l’âge de la majorité et être dotés de la pleine capacité juridique. Ils doivent être âgés de moins de 40 ans pour les dons de sperme et de moins de 35 ans pour les dons d’ovocytes. Sur autorisation de l’Autorité nationale pour la PMA, ces limites d’âge peuvent être étendues à 50 et 40 ans respectivement, dans le cas d’un don d’ovule fécondé ou s’il existe des motifs sérieux de le faire. Dans ce cas, des informations spécifiques doivent être fournies aux receveurs sur le risque accru de maladies génétiques, ainsi que sur la nécessité d’un examen prénatal.
Les donneurs sont soumis à des examens médicaux et de laboratoire spécifiques définis par l’Autorité nationale (eu égard aux évolutions scientifiques).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. Aux termes de la loi, la sélection du donneur relève de la responsabilité de l’unité de PMA. Au cours de cette sélection, d’autres critères tels que le groupe sanguin (Rhésus), ainsi que les caractéristiques phénotypiques, sont pris en considération. Les mêmes critères s’appliquent au don d’ovules fécondés.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le nombre d’enfants issus des gamètes d’un même donneur ne doit pas être supérieur à 10 ; cette limite peut toutefois être dépassée en vue de la naissance d’un nouvel enfant dans un couple qui aurait déjà eu un enfant issu des gamètes de ce donneur. L’Autorité nationale peut définir le nombre exact d’enfants pouvant être issus des gamètes d’un même donneur, en fonction de la population de chaque région et d’autres conditions spécifiques.
[Remarque : la loi fait référence au nombre d’enfants nés et non au nombre de cycles de traitement entrepris].
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Non. La loi ne contient aucune disposition applicable aux couples homosexuels.
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? L’article 28, paragraphe 1 de la loi 3305/05 concerne la prise en charge des procédures de PMA par la Sécurité sociale, dont les modalités seront définies par un décret présidentiel qui n’a pas encore été publié. Le même décret présidentiel évaluera les conditions dans lesquelles les personnes non assurées souhaitant avoir accès à une procédure de PMA pourront bénéficier d’une prise en charge par la Sécurité Sociale. Pour ce qui est de la couverture sociale, la situation en Grèce varie d’une caisse de sécurité sociale à l’autre. L’avis précité proposait une prise en charge à 100 % des médicaments nécessaires.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui. Le décret présidentiel qui sera publié selon les dispositions de la Loi 3305 régira les conditions générales et procédures de prise en charge financière par les organismes de sécurité sociale.
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Oui. L’avis présenté par l’Autorité nationale pour la PMA proposait de couvrir quatre tentatives de FIV/GIFT/ZIFT. L’avis contenait également un ensemble de critères médicaux et de limites d’âge. En ce qui concerne l’ICSI, l’avis proposait une prise en charge financière de 6 tentatives.
2. Des critères spécifiques sont-ils retenus pour l’accès à la PMA ?

Article 4, paragraphe 1 de la loi 3305/05 :
La loi ne prévoit aucune disposition pour les femmes ne vivant pas en couple hétérosexuel.
L’article 4, paragraphe 2 prévoit un examen obligatoire pour le VIH 1 et 2, l’hépatite B et C et la syphilis avant le début des procédures de PMA. Les personnes infectées par le VIH qui désirent bénéficier d’une procédure de PMA doivent demander une autorisation spéciale auprès de l’Autorité nationale de la PMA.
1. L’accès à la procréation médicalement assistée (PMA) (insémination artificielle, fécondation in vitro (FIV)) est-il :
La loi stipule que toutes les personnes adultes ont un droit d’accès aux méthodes de PMA ; pour les femmes, la limite d’âge est de 50 ans. Les personnes âgées de moins de 18 ans peuvent exceptionnellement se voir accorder le droit d’accès à la PMA, en cas de maladie très grave. La loi ne fait spécifiquement référence qu’aux couples mariés hétérosexuels désireux d’avoir un enfant et aux femmes célibataires ou vivant en couple hétérosexuel. Elle ne mentionne pas les couples homosexuels, mais leur interdit indirectement l’accès aux services de procréation assistée.
Conformément à la loi de 2002 [3089/02] :
16. Les dons suivants sont-ils anonymes ? sperme Oui / d'ovocyte Oui /d'embryon Oui.
La loi adopte le principe de l’anonymat pour tout don : par conséquent, l’identité du donneur ne peut en aucun cas être révélée.
Conformément à l’article 8, paragraphe 6 de la nouvelle loi, les informations médicales concernant le donneur sont conservées sous une forme anonyme codifiée à la Banque de cryoconservation et au Registre national des donneurs et des receveurs.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui/pour les parents Oui/pour un tribunal ? Oui.
L’enfant et son représentant légal ne peuvent avoir accès qu’aux données médicales qui sont gardées secrètes et conservées sous une forme codifiée dans les banques de cryoconservation.
La Loi 2472/1997 sur la protection des personnes à l’égard du traitement des données à caractère personnel qualifie les données médicales d’informations « sensibles » et attribue une compétence particulière à l’Autorité de protection des données (article 7).
Conformément à l’article 20, paragraphe 3 de la Loi 3305, l’accès au Registre national des donneurs et des receveurs n’est autorisé qu’à l’enfant et pour des raisons liées à sa santé, sous réserve de l’autorisation de l’Autorité de protection des données et du respect des conditions énoncées dans la Loi 2472/1997 concernant la protection des données à caractère personnel. Les parents ne peuvent avoir accès aux informations qu’à titre de représentants de l’enfant. Un tribunal peut ordonner l’accès aux informations.
En particulier :

L’enfant ou les parents (agissant comme les représentants de l’enfant) peuvent avoir accès aux informations de santé qui sont gardées secrètes et conservées sous une forme codifiée dans les banques de cryoconservation., mais pas à l’identité du donneur. Un tribunal peut également autoriser l’accès aux informations de santé.

18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Oui.
Contestation de maternité et de paternité : la contestation de paternité n’est pas autorisée quand le père a donné son consentement au début du traitement.
De même, conformément à la Loi 3089/2002, le consentement de l’homme et de la femme vivant en union libre est donné devant notaire afin de garantir leur filiation avec l’enfant à naître. Par conséquent, toute contestation de la filiation librement consentie est interdite.
Dans le cas d’une maternité de substitution, selon la loi, la femme qui a obtenu l’approbation du tribunal est considérée comme la mère légale de l’enfant. A titre exceptionnel, la mère porteuse ou la personne ayant sollicité ses services peuvent contester la maternité devant un tribunal, dans les conditions prévues par la loi.
19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? Aucun processus de révision n’est actuellement prévu pour cette loi

Conditions réglementées par la loi :
Deux lois sont maintenant en vigueur en Grèce :
La Loi réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître à la suite d’une procédure de procréation médicalement assistée (PMA). De plus, elle légalise l’insémination post-mortem et la maternité de substitution, sous certaines conditions spécifiées dans les articles pertinents.

La loi 3305 relative à la procréation médicalement assistée en Grèce a été adoptée en 2005. Cette loi, qui régit principalement le fonctionnement des unités de PMA, vient en complément de la précédente loi 3089, laquelle réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître. Elle porte sur les méthodes de PMA, les conditions de demande, les questions de consentement éclairé, la cryoconservation des gamètes, le don de gamètes, la recherche sur les embryons, la maternité de substitution, la traçabilité, etc. La loi prévoit par ailleurs des sanctions administratives et pénales pour ceux qui n’en respecteraient pas les dispositions. Elle met également en place le mécanisme de contrôle compétent, à savoir L’autorité Nationale pour la PMA. Aux termes de cette loi, les méthodes de PMA sont appliquées de manière à garantir le respect de la liberté de l’individu et du droit au développement de la personnalité (un droit protégé par la Constitution grecque), ainsi que la satisfaction du désir d’enfant, conformément aux principes de la bioéthique. La loi dispose en outre que l’application de ces méthodes doit toujours tenir compte du bien-être de l’enfant à naître. |
