Réglementation ou pratique et accès à la PMA
Titre de la législation : Il n’existe pas de texte législatif ni réglementaire de portée générale sur la procréation médicalement assistée en Pologne.
S’il n’existe pas d’instrument juridique, décrire la pratique : En l’absence de dispositions légales spécifiques, la PMA peut être pratiquée dans le respect des règles générales du droit médical et en particulier celles régissant la pratique de la médecine (comme le devoir d’informer les patients des conséquences médicales et juridiques, le devoir de respecter le secret médical aussi bien en ce qui concerne la PMA elle-même que l’identité du donneur de gamètes, le devoir de diligence dans le choix du donneur et l’examen du matériel génétique à utiliser, l’obligation de recueillir le consentement libre et éclairé), des droits des patients correspondants, des lois générales sur la famille, la filiation et l’état civil ainsi que du Code de l’éthique médicale (qui ne règle pas, lui non plus, cette question de manière spécifique). En outre, certaines questions sont traitées dans l’Avis de l’Association polonaise des obstétriciens relatif aux techniques de la PMA utilisées dans le traitement de l’infertilité, d’autres sont régies par les règlements internes des cliniques pratiquant la PMA (la pratique risque donc de ne pas être uniforme au niveau national).
