Le don de gamètes et d’embryons n’est pas anonyme, mais les informations sur l’identité du donneur de gamètes restent confidentielles. Toute donnée à caractère personnel recueillie sur un couple ou une femme célibataire sollicitant une PMA est également confidentielle.
Le Registre commun des donneurs de gamètes contiendra des données sur l’identité des donneurs de gamètes et sur les couples.
Ces données sont confidentielles. Toutefois, la loi pourra faire des exceptions dans certains cas, par exemple « quand il s’avère nécessaire de divulguer des informations sur les caractéristiques génétiques du donneur dans l’intérêt de la santé de l’enfant né d’une procédure de procréation assistée ».

Les données relatives à la santé du donneur de gamètes, et notamment les informations sur ses caractéristiques génétiques, peuvent être obtenues auprès du registre des donneurs de gamètes si cela est nécessaire pour la santé de l’enfant issu de la procédure de PMA.

Un couple ou une femme célibataire a le droit de demander et de recevoir des informations sur l’âge, l’apparence physique, l’origine ethnique et l’état de santé du donneur.
- Obligation pour le donneur de gamètes de fournir des informations concernant sa santé :
En vertu du projet DL-RHRR, les donneurs de gamètes ont l’obligation de fournir des informations médicales personnelles complètes et détaillées sur leur état de santé avant d’effectuer le don.
- Droit du donneur de gamètes à recevoir des informations sur sa santé :
En vertu du projet DL-RHRR, les donneurs de gamètes ont le droit de recevoir les informations concernant leur santé susceptibles d’être découvertes dans le cadre du suivi de l’enfant né d’une procédure de procréation médicalement assistée.
18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Actuellement, le droit de la famille ne prévoit pas de disposition spécifique en la matière.
