19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? -
20. Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire.
- ART. 1-4 : l’accès aux technologies de PMA n’est autorisé que lorsque les causes de la stérilité ne peuvent être traitées par d’autres moyens. Ces techniques sont appliquées graduellement et requièrent le consentement écrit et éclairé du couple.
- ART. 5 : seuls les couples hétérosexuels, de plus 18 ans et en âge de procréer ont accès à la PMA.
- ART. 8-9 : l’enfant né après procréation assistée a le statut d’enfant légitime et reconnu et ne peut être désavoué.
- ART. 10-11 : la PMA ne peut être pratiquée que dans des centres habilités et accrédités par l’Istituto Superiore di Sanità.
- ART. 13-14 : toute expérimentation sur l’embryon est interdite. La recherche clinique sur l’embryon n’est autorisée que dans l’intérêt de l’embryon.
- Il n’est pas possible de créer un nombre d’embryons supérieur à celui strictement nécessaire à la réalisation d’une implantation unique et simultanée (ce nombre ne pouvant en aucun cas être supérieur à trois).
- La cryoconservation n’est autorisée que si l’état de santé (transitoire) de la femme concernée l’exige.
- ART. 16 : L’objection de conscience est également reconnue.
