La Bosnie-Herzégovine n'a toujours pas de législation spécifique sur la PMA couvrant l'ensemble du pays. Actuellement, la PMA est régie par les statuts de la législation sur l'assurance maladie (dans les deux entités de Bosnie-Herzégovine: la Fédération de Bosnie-Herzégovine et la République serbe de Bosnie et le district de Brcko), réglementant principalement les droits du couple au remboursement des frais de FIV pour deux procédures.

Dans l’entité Republika Srpska et le district de Brcko, la caisse d’assurance maladie approuve chaque année le budget du MAP, en fonction de la disponibilité des fonds.

La PMA en tant que procédure médicale est bien établie dans les secteurs public et privé en Bosnie-Herzégovine.

Actuellement (janvier 2017), le nouveau projet de loi sur la PMA (proposé par le parti démocrate socialiste MS) fait actuellement l'objet d'une procédure parlementaire dans la Fédération des entités de Bosnie-Herzégovine, tandis que le projet de loi sur la PMA élaboré par le ministère de la Santé compétent sera à l'ordre du jour du Parlement en 2017, aussi.
