19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ?
Pas actuellement, mais une loi modifiée sur la procréation médicalement assistée a été adopté en 2001, rendant entre autres les services de PMA librement accessibles aux femmes célibataires sans partenaire masculin et sans problème médical de fertilité, ce qui était impossible aux termes de la précédente loi (2000). Un groupe d’opposition au Parlement a appelé à un référendum législatif, ce qui a suscité un débat public animé. Le Comité national d’éthique médicale (NMEC) et le Conseil national de la santé ont déconseillé le recours arbitraire à la médecine pour les interventions susceptibles d’avoir de lourdes conséquences, lorsqu’il n’existe comme dans ce cas aucune indication médicale valable. Le NMEC a cité le rapport de 1989 du CAHBI (Comité ad hoc d’experts sur les progrès des sciences biomédicales) sur la procréation artificielle humaine, qui limite l’utilisation des procédures de PMA aux couples hétérosexuels et aux situations d’indications médicales strictes (infertilité, échec d’autres méthodes de traitement, nécessité d’éviter la transmission d’une maladie grave), comme le prévoyait la précédente loi.
Lors du référendum, la nouvelle loi a été rejetée avec une majorité écrasante de presque 3 contre 1. Par conséquent, la loi de 2000 décrite ci-dessus est restée en vigueur.
20. Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire.
