16. Les dons de sperme/d'ovocyte/d'embryon sont-ils anonymes ?

L’article 18 énonce les règles de confidentialité applicables aux couples qui bénéficient de la PMA et aux donneurs de gamètes.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon pour l’enfant lui-même Non/pour les parents Non/pour un tribunal ? Oui.
Art. 18 : Tout enfant mentalement capable pourra demander des informations médicales importantes sur le donneur dès l’âge de 15 ans. Le représentant légal de l’enfant ne pourra obtenir ces informations que sur autorisation du tribunal, lorsque des raisons médicales exceptionnellement importantes l’exigent.
Le médecin de l’enfant a un droit d’accès aux informations contenues dans le registre des donneurs, pour des raisons de santé.
Le tribunal et l’administration ont un droit d’accès au registre en cas d’absolue nécessité pour l’accomplissement de leurs missions officielles telles que prévues dans la loi.
En particulier :

18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ?
En principe, non.
- Art. 41 : La maternité ne peut être contestée si la mère avait donné son consentement à une procédure de PMA. Si un ovule provenant d’un don est utilisé, la donneuse ne peut revendiquer la maternité de l’enfant, et la maternité biologique ne peut être établie au bénéfice d’un tiers.
- Art. 42 : La paternité ne peut être contestée, sauf si le requérant soutient que l’enfant n’a pas été conçu par PMA. Dans ce cas, les articles 96-99 de la loi sur le mariage et les relations familiales s’appliquent.
Lorsque du sperme provenant d’un don est utilisé, le donneur ne peut revendiquer la paternité de l’enfant, et la paternité biologique ne peut être établie au bénéfice d’un tiers.
