6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui d’ovocyte ? Oui c. d’embryon ? Oui
Le don de gamètes et d’embryons est en principe autorisé à la fois par la Loi sur les soins de santé et par le projet de Loi sur la santé reproductive et les droits en matière de procréation.
Cependant, la Loi sur les soins de santé ne prévoit aucune disposition spécifique en la matière. Elle ne contient qu’une disposition générale selon laquelle les gamètes des donneurs ou les embryons peuvent être utilisés à des fins de PMA.
Le projet de loi sur la santé reproductive et les droits en matière de procréation est plus précis. Il consacre un chapitre distinct au don de gamètes, et en définit les conditions et les procédures.
7. Des mesures de compensation sont-elles prévues pour de tels dons ?
LHC : Non
DL-RHRR : Non. Conformément à l’article 20 du DR-RHRR, « le don de gamète n’est pas remboursé. Un donneur recevra une compensation pour le temps passé et les autres frais engendrés par le don (par exemple, le transport, l’absence au travail, etc.) ».
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? d’ovocyte ? d’embryon ?
LHC : Non DL-RHRR : Oui
DL-RHRR :
Un donneur de gamètes doit être un homme ou une femme capable, âgé(e) de 18 ans au moins et ne présentant aucune des maladies définies par la loi.
La fusion du sperme ou de l’ovule de parents génétiques dans le cadre de techniques de procréation médicalement assistée est interdite.
Un gamète ne peut être prélevé sur un homme décédé que si ce dernier a rédigé une directive anticipée spécifiant qu’il acceptait que ses gamètes soient utilisés après sa mort pour une insémination artificielle homologue ou une fécondation in vitro de l’ovule de son épouse, avec laquelle il s’est marié conformément aux règles définies par la législation de Géorgie. En revanche, il est interdit de prélever un ovule ou un ovaire sur une femme décédée pour une procédure de procréation médicalement assistée.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA?
LHC : Non
DL-RHRR : Oui
Selon le projet de Loi sur la santé reproductive et les droits en matière de procréation, un couple ou une femme célibataire a le droit de choisir un donneur en fonction de son âge, de son apparence physique, de son origine ethnique et de son état de santé. Cependant, les informations sur l’identité d’un donneur de sperme restent confidentielles.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ?
LHC : Non
DL-RHRR : Oui
Les deux principes suivants ont été ajoutés au projet de Loi (DL-RHRR) pour éviter la consanguinité :
- Les gamètes d’une même personne ne peuvent pas être utilisés plus de trois fois (trois utilisations aboutissant à la naissance d’un enfant) ;
- Un registre commun des donneurs de gamètes sera mis en place, qui rassemblera des données sur les personnes participant à des procédures de procréation médicalement assistée avec don de gamètes.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Non
