En Irlande, jusqu’à une date récente, l’offre de services de procréation assistée était très peu réglementée. Cependant ; en avril 2015, le Parlement a adopté la Loi sur l’enfant et les liens de parenté (Children and Family Relationships Act), qui aborde le sujet de la filiation dans le cadre limité de la procréation assistée avec donneur. En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d'embryons est autorisé sur une base non anonyme. En outre, cette législation prévoit la création d'un registre national des donneurs de gamètes / embryons, des receveurs et des enfants conçus par donneur (Registre national des personnes conçues par des donneurs), qui permettra aux enfants conçus par donneur d'accéder à certaines informations concernant le gamète / donneur d'embryons impliqué dans les procédures conduisant à leur conception.
De plus, bien que les services de procréation assistée ne soient pas réglementés par une législation spécifique relative à la santé, en février 2015, le ministre de la Santé a obtenu l’accord du gouvernement en vue de l’élaboration d’un ensemble de dispositions législatives sur un grand nombre de questions englobant toutes les phases du processus de procréation assistée. A la suite de l'achèvement du régime général, le gouvernement a approuvé sa publication et l'élaboration d'un projet de loi sur l’assistance médicalisée à la procréation basé sur le régime général. La rédaction de ce projet de loi est actuellement en cours.
Sous cette législation proposée, un certain nombre de pratiques seront réglementées parmi lesquelles le don de gamètes et le don d’embryon, la maternité de substitution et la filiation dans de tels cas, le dépistage/diagnostic génétique préimplantatoire, le choix du sexe à des fins médicales, et la procréation assistée post mortem ainsi que la recherche connexe. Il est également proposé d’établir dans la législation une instance de contrôle pour assurer la sécurité du patient et le respect des bonnes pratiques cliniques dans le domaine de la procréation assistée. Cette instance maintiendra le Registre national des personnes conçues par des donneur, établira le Registre National de la GPA et ainsi que tiendra un registre de tous les activités et les services de PMA.
En janvier 2018, le régime général a été soumis à la commission parlementaire compétente pour instruction dans le cadre du processus d'examen pré-législatif. Ce comité a publié le rapport de son examen en juillet 2019, en formulant des recommandations comprenant des propositions liées à la fois à des objectifs politiques généraux et à des modifications plus techniques. Ses recommandations sont examinées au cours du processus continu de rédaction du projet de loi sur la procréation assistée – AHR Bill.
