Le don de gamètes et d’embryons est en principe autorisé à la fois par la Loi sur les soins de santé et par le projet de Loi sur la santé reproductive et les droits en matière de procréation.
Cependant, la Loi sur les soins de santé ne prévoit aucune disposition spécifique en la matière. Elle ne contient qu’une disposition générale selon laquelle les gamètes des donneurs ou les embryons peuvent être utilisés à des fins de PMA.
Le projet de loi sur la santé reproductive et les droits en matière de procréation est plus précis. Il consacre un chapitre distinct au don de gamètes, et en définit les conditions et les procédures.
7. Des mesures de compensation sont-elles prévues pour de tels dons ?

DL-RHRR : Non. Conformément à l’article 20 du DR-RHRR, « le don de gamète n’est pas remboursé. Un donneur recevra une compensation pour le temps passé et les autres frais engendrés par le don (par exemple, le transport, l’absence au travail, etc.) ».

Un donneur de gamètes doit être un homme ou une femme capable, âgé(e) de 18 ans au moins et ne présentant aucune des maladies définies par la loi.
La fusion du sperme ou de l’ovule de parents génétiques dans le cadre de techniques de procréation médicalement assistée est interdite.
Un gamète ne peut être prélevé sur un homme décédé que si ce dernier a rédigé une directive anticipée spécifiant qu’il acceptait que ses gamètes soient utilisés après sa mort pour une insémination artificielle homologue ou une fécondation in vitro de l’ovule de son épouse, avec laquelle il s’est marié conformément aux règles définies par la législation de Géorgie. En revanche, il est interdit de prélever un ovule ou un ovaire sur une femme décédée pour une procédure de procréation médicalement assistée.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA?

Selon le projet de Loi sur la santé reproductive et les droits en matière de procréation, un couple ou une femme célibataire a le droit de choisir un donneur en fonction de son âge, de son apparence physique, de son origine ethnique et de son état de santé. Cependant, les informations sur l’identité d’un donneur de sperme restent confidentielles.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ?

Les deux principes suivants ont été ajoutés au projet de Loi (DL-RHRR) pour éviter la consanguinité :
- Les gamètes d’une même personne ne peuvent pas être utilisés plus de trois fois (trois utilisations aboutissant à la naissance d’un enfant) ;
- Un registre commun des donneurs de gamètes sera mis en place, qui rassemblera des données sur les personnes participant à des procédures de procréation médicalement assistée avec don de gamètes.

En vertu de l'article 3a, paragraphe 2, de la loi sur la protection de l'embryon, un diagnostic génétique préimplantatoire est exceptionnellement autorisé lorsque les prédispositions génétiques de la femme sur laquelle l'ovule a été prélevé, ou celles de l'homme produisant le spermatozoïde, ou les deux, suggèrent que leur progéniture sera très probablement atteinte d'une maladie génétique grave ou qu'elle présentera une anomalie très probablement à l'origine d'une mortinaissance ou d'une fausse-couche. En ce qui concerne les autres exigences relatives à un diagnostic génétique préimplantatoire, il est fait référence à l'article 3a, paragraphes 2 et 3, de la loi sur la protection de l'embryon (Embryo Protection Act). Dans ces cas, l'exécution de la PMA dépend du résultat du diagnostic génétique préimplantatoire.
c. Autres
Conformément à l'article 6, paragraphe 2, de la loi sur la réglementation des tissus et des cellules, l'utilisation de spermatozoïdes pour la fécondation hétérologue, en tant que technique de procréation médicalement assistée, exige que le donneur de sperme soit jugé médicalement apte au don de sperme, eu égard à son âge, à son état de santé et à ses antécédents médicaux, et que l'utilisation du sperme donné ne présente pas de risques pour la santé d'autrui. Les donneurs de sperme sont sélectionnés selon les critères et les tests de laboratoire définis à l'annexe 4, numéros 2 et 3, du règlement sur les tissus et les cellules de la loi sur la transplantation. L'annexe 4 a transposé en droit national les critères de sélection et les tests de laboratoire pour les donneurs de cellules reproductrices définis à l'annexe III de la directive 2006/17/CE du 8 février 2006 relative à certaines exigences techniques concernant le don, l'obtention et le contrôle de tissus et de cellules d'origine humaine. À cette fin, les échantillons de sérum ou de plasma des donneurs doivent notamment être testés et s'avérer négatifs pour le VIH 1 et 2, le VHC, le VHB et la syphilis. En outre, les échantillons d'urine des donneurs de sperme doivent être testés et déclarés négatifs pour la chlamydia par la technique d'amplification de l'acide nucléique (NAT).

3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Non. Du fait de la conjoncture économique difficile dans le pays, le Système d’assurance maladie et de sécurité sociale ne peut prendre en charge les procédures de haute technologie comme la PMA.

Irlande - Situations particulières relevant de ces questions dans votre pays
19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? Oui. Le projet de régime général des dispositions législatives a été achevé et soumis à la commission parlementaire compétente qui a publié le rapport de son examen en juillet 2019, en formulant des recommandations comprenant des propositions liées à la fois aux objectifs politiques généraux et aux modifications plus techniques. Ses recommandations sont examinées au cours du processus en cours de rédaction de ce projet de loi sur la procréation assistée. Avant la promulgation de la Loi de 2015 sur l’enfant et les liens de parenté, les procédures de procréation assistée étaient très peu réglementées. Il y a eu et il continuera d’y avoir un engagement fort de tous les acteurs concernés et un débat national sur ces questions sensibles et complexes.
20. Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire.
Roche -v- Roche & ors (2009)
La Cour suprême a rejeté à l’unanimité un recours formé par une mère séparée demandant à ce que lui soient transférés trois embryons congelés contre la volonté de son conjoint dont elle était séparée.
La requête demandait l’examen des questions suivantes :
- Y-a-t-il un accord ayant force exécutoire entre les parties quant au devenir des embryons congelés ?
- La protection constitutionnelle accordée à la vie du fœtus (article 40.3.3) s’étend-elle aux trois embryons en question/
Jugement
Accord ayant force exécutoire :
Au cours du traitement, les parties ont signé quatre formulaires de consentement comme requis par le centre de PMA. En tant que formulaires de consentement, ils ne répondaient pas aux critères requis pour être des contrats au sens de la loi.
Aucun des formulaires de consentement n’évoquait la question des trois embryons congelés surnuméraires : il n’y avait donc pas de preuve que le défendeur avait donné son consentement à leur implantation.
Protection constitutionnelle :
L’article 40.3.3 de la Constitution irlandaise protège le droit à la vie de l’être non né (unborn) « en respectant pleinement le droit égal de la mère à la vie ». La Cour a interprété cette disposition comme signifiant qu’il doit y avoir un lien physique entre de l’être non né (unborn) et la mère, c’est à dire l’implantation dans l’utérus.
La Cour a décidé que l’objet du 8e amendement à la Constitution (Référendum de 1983) était d’empêcher la dépénalisation de l’avortement et que les questions relatives à la FIV n’avaient pas été prises en considération ou prévues.
Il a été dit dans un certain nombre de jugements que si le respect de l’embryon était porté au point de l’assimiler à un « l’être non né» (unborn), des cas pourraient se présenter dans lesquels certaines méthodes de contraception, par exemple la contraception d’urgence (pilule du lendemain), deviendraient illégales.

MR and Anor – v- An tArd Chlaraitheoir & Ors [2014]
Cette affaire concernait une entente par laquelle une femme consentait à être mère porteuse pour sa sœur et son beau-frère (le couple). Le couple a fourni le matériel génétique (ovocyte et sperme) qui a permis la naissance de jumeaux. L’homme et la femme demandaient à faire modifier le registre des naissances afin d’y figurer comme les parents légaux. L’état civil a refusé de le faire sur la base du principe selon lequel la femme qui donne naissance à l’enfant est toujours considérée comme sa mère légale. Ce refus a été contesté devant la Haute Cour de Justice.
Dans sa décision du 5 mars 2013, le juge Abbott a donné raison au couple. Il affirmait que la mère génétique, et non la mère ayant donné naissance aux enfants, était la mère légale, et que la personne qui présentait le lien génétique/sanguin avec les enfants avait le droit d’être enregistrée en tant que parent sur le certificat de naissance.
En février 2014, l’Etat a fait appel de la décision du juge Abbott, au motif qu’elle pourrait créer une incertitude juridique quant aux droits parentaux et à l’ascendance parentale des enfants nés à la suite d’un don d’ovocyte, dénigrer le rôle de la mère de naissance, donner le sentiment que la maternité de substitution à but lucratif n’est pas illégale et conduire l’état civil à demander une preuve génétique de maternité pour chaque naissance.
En novembre 2014, la Cour suprême a renversé la décision de la Haute Cour de justice, estimant que l’affaire avait soulevé des questions sociales importantes et complexes qui devaient être réglées par le Parlement (Oireachtas) plutôt que par la justice.

En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d’embryon est autorisé sur une base non anonyme. La législation prévoit aussi la mise en place d’un registre national des personnes conçues grâce à un don qui permettra aux enfants issus de donneurs d’avoir accès à certaines informations concernant le donneur de gamètes/d’embryon qui a permis leur conception. Il est prévu que le projet de législation relatif à la procréation assistée traite des questions générales liées à la conception par donneur (par ex. limites d’âge, dépistage, périodes de conservation, interdiction de la consanguinité et dons à des fins de recherche).
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d’embryon à visée commerciale est interdit. Le don de gamètes et d’embryons ne peut être qu’un don altruiste, mais le remboursement des dépenses raisonnables engagées dans le cadre du processus de don est possible. On entend par « dépenses raisonnables », aux fins de la loi, les frais de déplacement, les dépenses médicales et éventuels frais juridiques ou de consultant engagés par le donneur.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui/ d’ovocyte ? / Oui d’embryon ? Oui
La loi de 2015 sur l’enfant et les liens de parenté définit un certain nombre de critères pour le consentement des donneurs de gamètes/d’embryon. Ainsi, le donneur – homme ou femme – doit être âgé de plus de 18 ans et avoir donné son consentement écrit ainsi que la confirmation qu’il a bien été informé qu’il ne sera pas le parent d’un enfant issu du don. Le consentement doit être signé en présence d’un témoin. Lors du consentement, le donneur doit donner son accord à la publication d’informations le concernant dans le Registre National des Personnes Conçues grâce à un Donneur. Le consentement doit également indiquer que le donneur a été informé qu’un enfant issu de son don peut chercher à le contacter. Les centres de PMA doivent s’assurer que lorsque des gamètes/embryons issus de dons sont importés d’un autre pays, le processus de consentement en vigueur dans ce pays est conforme aux exigences précitées. Le projet de législation sur la procréation assistée prévoit que les donneurs subiront des examens médicaux conformes aux exigences figurant dans le Texte réglementaire n°158/2006 – Réglementation 2006 des Communautés européennes (qualité et sécurité des tissus et cellules humains).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? L’Irlande a une population relativement faible, ce qui pourrait augmenter le risque de consanguinité par inadvertance entre individus conçus au moyen des gamètes du même donneur. Il est proposé que la législation sur la procréation assistée fixe une limite maximale de quatre familles auxquelles des gamètes / embryons d’un même donneur pourront être donnés.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Aux termes de la Loi de 2015 sur l’enfant et les liens de parenté, les parents d’un enfant conçu grâce à un don dans le cadre d’une procédure de procréation assistée sont :
(a) la mère,
(b) l’époux, le partenaire civil ou le concubin de la mère, selon le cas.
La loi de 2015 n'inclut pas la gestation pour autrui.

Tous les renseignements personnels relatifs au receveur de gamètes, au donneur de gamètes ou à l'enfant, conçu au cours de la PMA à l'aide de gamètes du donneur, sont confidentiels. Cependant, un Tribunal peut permettre la divulgation des informations sur le(s) donneur(s) et les enfants si cette information est nécessaire pour la santé de l’enfant ou du donneur ou pour des autres raisons valides. Quand un enfant né grâce à une procédure de MAP atteint l’âge de 18 ans, l’identité du donneur peut aussi être divulgué, si celui donne son consentement.

Conformément à l'article 10 de la loi sur la reproduction assistée de la République de Lituanie, des informations sur :

Non. Les personnes qui ont signé un consentement éclairé à la procréation assistée sont considérées comme les parents légaux de l'enfant né après la procréation assistée.
Grèce - Réglementation ou pratique et accès à la PMA
Deux lois sont maintenant en vigueur en Grèce :
La Loi réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître à la suite d’une procédure de procréation médicalement assistée (PMA). De plus, elle légalise l’insémination post-mortem et la maternité de substitution, sous certaines conditions spécifiées dans les articles pertinents.

La loi 3305 relative à la procréation médicalement assistée en Grèce a été adoptée en 2005. Cette loi, qui régit principalement le fonctionnement des unités de PMA, vient en complément de la précédente loi 3089, laquelle réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître. Elle porte sur les méthodes de PMA, les conditions de demande, les questions de consentement éclairé, la cryoconservation des gamètes, le don de gamètes, la recherche sur les embryons, la maternité de substitution, la traçabilité, etc. La loi prévoit par ailleurs des sanctions administratives et pénales pour ceux qui n’en respecteraient pas les dispositions. Elle met également en place le mécanisme de contrôle compétent, à savoir L’autorité Nationale pour la PMA. Aux termes de cette loi, les méthodes de PMA sont appliquées de manière à garantir le respect de la liberté de l’individu et du droit au développement de la personnalité (un droit protégé par la Constitution grecque), ainsi que la satisfaction du désir d’enfant, conformément aux principes de la bioéthique. La loi dispose en outre que l’application de ces méthodes doit toujours tenir compte du bien-être de l’enfant à naître. |

20. Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire.
Il convient de noter que la PMA n’est actuellement pas réglementée au Luxembourg. Toutefois :
- l’article 312 du Code civil dispose que le désaveu d’un enfant en justice par le conjoint de la mère n’est pas recevable « s’il est établi, par tous moyens de preuve, que l’enfant a été conçu par voie d’insémination artificielle, soit des œuvres du mari, soit des œuvres d’un tiers du consentement écrit du mari ».
- le plan hospitalier national adopté en 2001 par voie réglementaire prévoit la création d’un service de PMA dans un hôpital général disposant d’un service d’obstétrique.
Entre-temps, la création d’un service de PMA a effectivement été autorisée au Centre Hospitalier de Luxembourg. Ce service est opérationnel. Les données fournies en réponse au questionnaire correspondent aux pratiques de ce service.
Un projet de loi en matière de PMA est actuellement devant le Parlement. Ce dernier avait prévu de mener un large débat d’orientation, mais il n’a pas encore eu lieu à ce jour.
La Commission nationale d’éthique a émis un avis très complet sur tous les aspects de la PMA.

3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui. L'infertilité est bien une maladie lorsqu'elle est biologique ; cependant, l'infertilité sociale est vraisemblablement autorisée par la loi en raison de l'égalité des droits pour les couples mariés.

L'article 19 comporte deux dispositions :
19(1) : Que tout enfant issu d'une procréation médicalement assistée, y compris les cas où l'enfant est né de cellules germinales données ou d'un embryon donné, sera considéré comme l'enfant du ou des futurs parents qui ont exprimé leur consentement à la procédure. La loi stipule également qu'à toutes fins utiles, l'enfant sera considéré comme étant "né naturellement du ou des mêmes parents potentiels". L'enfant sera inscrit dans tout acte d'état civil en tant que descendant direct de ce ou ces futurs parents, qui ont alors les droits et les devoirs prévus par la loi à l'égard de l'enfant.
L'article 19(2) stipule explicitement qu'il n'existe aucun lien de filiation entre l'enfant né de cellules germinales données ou d'embryons adoptés et les personnes dont proviennent les cellules germinales données ou les embryons adoptés.
Note : (Il est intéressant de noter que, d'un point de vue scientifique, cette disposition reconnaît également que la mère gestationnelle est plus importante que la mère génétique dans ces circonstances).
La loi ne mentionne pas explicitement les cas cochés "NON" ci-dessus, mais l'article 22 de la loi oblige le titulaire de l'autorisation qui pratique la PMA à "tenir un registre confidentiel contenant tous les détails de chaque procédure de procréation médicalement assistée, don de lignée germinale, cryoconservation de cellules germinales et cryoconservation d'embryons en vertu de la présente loi et à transmettre ces informations à l'Autorité sans délai".
Note : On peut donc supposer que l'Autorité peut, dans certaines circonstances, par exemple pour des raisons de santé, donner l'autorisation de révéler les identités. Ce n'est cependant pas explicitement indiqué, mais tenir le registre signifie implicitement disposer d'un filet de sécurité.
18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Non. Voir les commentaires au point 19
